      • So I have now been shown proof that kabam didnt take all the gems from all players. Numerous players were allowed to keep 100k or more gems while others had everything taken. Most that got to keep were in same few alliances. The ppl removing were left at their own descression on how much to take. This now changes it to a clear case of discrimination and game rigging. The illegal infractions are piling up kabam.... better get it together!!!!

            • Yes, "Glitch" is the correct term.

This was clearly not the intent of the tournament and should have been clear to any reasonable person. That's the standard folks, google it. "Reasonable person standard"

Basically could a "Reasonable person" say 20 gems for one lep, 120,000 gems for 5 leps, and 250 gems for 10 leps is anything but a clear and definitive error/glitch?

It is very very very clear that a "reasonable person" would look at that and know it is an error/glitch.

                  • Look, if you are going to be taken seriously you have to be reasonable as well. The flat out truth is that anyone who claimed 120k gems in this situation knew this wasn't the norm, so they have no reason at all to complain about kabam reversing the transaction.

HOWEVER, Kabam does hold a responsibility to correct the error in an equitable manner (to the extent possible, otherwise make whole those who cannot be equitably repaired). Kabam's response seems rushed and not equal. The reversal of gems and the sudden shutdown of the game is clear and evident acknowledgment of the error/glitch. Kabam has a responsibility they have not yet done this, they have only covered their own end as best they could for their own interests, however they have a responsibility to the players/customers that they have not fulfilled.

                    • The "glitch" was a free way to get gems available to everyone. If you didn't know about it meant no one in your alliance likes you. I play across different servers and everyone in all my alliances knew about it. The event center clearly said 5 leprechaun for 1000x chests. If that's not what was intended than that's on them. Players built cities to participate and did so. Out of the millions of gems everyone could of gotten only maybe 120k were probably unlocked and in circulation due to the slow opening/clicking of the boxes. How does this differ from the chests that "offer" 100k gems or even 1mil gems? If the event in round tower said 5 leprechaun for 1x but we got 1000x than fine. But it didn't. As far as banners, no banner had description of the details of the event but that it was going on. And as many know not everyone gets in game mail. I for one haven't gotten a in game mail from kabam in over 6months. I'm still waiting for them to contact me about the lvl *4 orb I won a long time ago. Only way to fix this is give the players the gems back or offer every player in game a substantial amount of gems as a compensation. 100 gems does nothing to the 87k that was taken from me. And yes I do have screen shots of all the gems/boxes and round tower info.

Come on spize, when has kabam ever been reasonable. 68 is the most affected world. The problem is that they didn't take evenly from everyone. Watch and see our world is about to change drastically. Also it isnt reasonable that two players in the same world who got the same # of these gems lose drastically different amounts. But that is what has now happened

You can show me as many screen shots as you want, it won't change anything. I'm not saying it did not.

I'm saying you're lying to yourself and everyone else if you thought it was anything but an error.

I don't even blame you for exploiting the error. Kabam has been terrible about errors, lack of fixes, and flat out scams. However you also can't really complain about them taking back gems you should have never had and should have known were not the intended prize to begin with.

Come on man, you can convince me of a lot of things, but not that you actually believed 1-20, 5-120,000, and 10-250 payout was anything but an error/glitch.

I never said they were reasonable. I agree fully that unless they fully fix this and do it quickly the world and game in general is lost.

I listed in another thread in the general forum my suggested fix. It sucks, but it is about the only honest and equitable fix I can think of.

                              Honestly, what a joke.

You cannot tell me that an ally TOM that offers gems and gets top 3 of less than a bil then after the glitch and fix we are just a few hours in and the top 3 in the same server are 3.5bil each and the prize is gear we all just won 5 sets of over the last 3 days.

Nonsense... we have guys that were 50mil might 3 days ago that are now 1.3bil might. You expect me to believe these guys are putting $3000 each on the credit card for celtic gear armory chests?

Other than turning back the server 2 days and giving everyone 5,000 gems to make up for the loss of the items they legit won or bought the last two days (refund all KOC purchases as well) you really have no other way to fix this.

It may sound expensive, but I can assure you as an expert in the field of business, you are going to lose a lot more money from people walking away from a now uncompetitive game than you'd lose from owning up to this mistake and providing a REAL fix.

Step 1: Admit there was a glitch that allowed an exploit to occur.
                              Step 2: Apologize.
Step 3: Put game into maintenance mode
Step 4: Reverse all purchases over the past 48 hours
Step 5: Restore the game and roll back all servers by 48 hours (pre-glitch)
Step 6: Provide every member on every server 5,000 gems as an olive branch
Step 7: Provide multiple levels of oversight to prevent future issues

That's really the only possible way to fix this that I can think of. It's painful and those with the glitch items and gems are not going to like it... but let's be real, 120,000 gems for 5 leps when 10 bought you 250 gems and 1 bought you 20 was about as obvious of a glitch as you can get and NO court of law would take such nonsense.

Trust me, I've been in business myself for 15 years and I've had technical glitches give outrageous deals on both ends (ordering and selling) and when it's as blatant and error as this it's simply not going to hold up in ANY court of law or equity. No judge would ever enforce such an obvious error.
This is my post in the other thread.

                              • I'd like to throw in my 2 cents worth...

                                1. It wasn't a glitch, it was an oversight issue. That is the company's problem, not the recipients of the prizes. If you competed in a competition in the street and were given 2 prizes instead of 1, you can't be forced to return the other prize. Just because Kabam has our accounts on their servers does not give them the right to go in and take out prizes, just like the person that gave you the extra prize on the street can't walk into your house and take both prizes back because the screwed up.

                                2. The ToS have been referred to often. Yes, you agree to the ToS to play the game. However, as has been proven many times in court, contracts mean nothing. By selling a product and offering a competition through a specific country's iTunes App Store/Google Play, they have to abide by the Consumer Protection Laws of that country. I'm in Australia and can tell you that the Kabam ToS do not abide by the consumer laws as enforced by the ACCC. However, since online "in-app" purchases and "virtual currency" are such a grey area regarding the validity of the product purchased/won, as well as the location of the company's head office, make enforcement hard for the relevant consumer authorities.

                                3. There are many fixes available, but the path Kabam has taken is a PR nightmare for them, and inadvertently opened themselves up to litigation by removing actual purchased items. If they hadn't done that, people would have had a whinge and gotten over it. Though the ToS states that they can, refer to point 2 where it fails to comply with your relevant countries consumer protection laws.

I personally have received legal advice on this matter and have been advised that there is a case against Kabam for what has happened. I have sent Kabam a complaint, and am awaiting a response from them. Once I have had a chance to find out what their response will be, I will then take further action if required.

In a nutshell, the ball is in Kabam's court now, and they have to be very careful how they proceed legally. Many developers such as Kabam have publically stated how much these games are benefiting them financially. To then defraud players of purchased items would not sit very well with any Judge outside of the Cayman Islands.
